These Terms are an agreement between you and MB Move Better LLC, of South Lake Tahoe, California ("we," "us"). By using mbmovebetter.com or buying a service, you agree to them. Sections 7, 8, and 10 affect your legal rights; please read them.
1. What we offer
Online and in-person fitness, movement, and general nutrition coaching, at the prices shown when you buy:

- Virtual Movement + Posture Assessment — $299. Adds movement videos, range-of-motion and mobility analysis, an Individualized Corrective Movement Program, and a 30-minute video review. You record sixteen short movement tests and send them in one transfer through a file-request link. Your report and program arrive together by link within five business days of your complete submission — that is, once your intake, your three photos and all sixteen videos have been received — along with a link to book the 30-minute review call; we ask you to book it within seven days.

2. Eligibility
You confirm that: (a) you are 18 or older; (b) you are physically able to take part in an exercise program or have written clearance from a licensed physician, and you will get clearance if our screening or your own judgment suggests it; (c) you are located where online fitness and general nutrition guidance is lawful; and (d) what you tell us is accurate. Coaching placements are confirmed by application and subject to capacity.
3. Digital delivery
Assessments, programs, and reports are delivered electronically — as PDFs, or by link to your email. Keep your email and phone current and check them. Fulfilment of an assessment begins when your submission is complete: intake and photos for the $149, and intake, photos and all sixteen movement videos for the $299.
4. Payment, refunds, credits, and subscriptions
Payment is collected in full before work begins, through Stripe, in U.S. dollars.
Refunds. The Refund & Credit Policy is part of these Terms. In short: full refund of an assessment any time before you submit intake and photos; no cash refunds once fulfilment begins; if your report does not reflect what you submitted, one revision at no charge.
Non-submission. If 30 days pass without your intake and photos, your purchase converts to a credit toward any service, valid six months from conversion. We email you when that happens.
The $149 credit. Enroll in the Movement-Based 12-Week Program ($499) or start any coaching plan within 30 days of your posture report being delivered and the $149 is applied to the program price or to your first month of coaching. One use; not transferable; no cash value; void if the assessment is refunded.
Coaching subscriptions (automatic renewal). Coaching is billed monthly on your sign-up date with a three-month minimum term. After the minimum, your plan renews automatically each month at the same price until you cancel. Before you buy, we show the price, billing frequency, minimum term, and how to cancel next to the purchase button, and you must actively tick a box to agree. After you buy, we email an acknowledgment restating those terms and the cancellation method. Cancel online via the link in that email or your account, or by emailing matt@mbmovebetter.com. Cancellation takes effect at the end of the minimum term or, after that, at the end of the billing period you have already paid for — cancel before your next billing date and you are not billed again. No partial-month refunds, no proration, and the three-month minimum is firm.
In-person sessions are scheduled by mutual confirmation and charged at your tier's rate. They take place at Athletics Gym in South Lake Tahoe, California, which we do not own or run. You need an active membership there or the day pass the gym requires; the gym sets that price, it is yours to pay, and it is not included in your monthly price. You agree to follow the gym's rules while you are there. Travel outside Matthew's normal training location is not included. Training somewhere else is by written agreement only, and any travel fee is agreed beforehand based on the location. You can cancel or move a session at no cost with at least 24 hours' notice; inside 24 hours the session is charged or forfeited.
Chargebacks. Contact us before disputing a charge; most issues are solved in a day. We keep records of your acceptance of these Terms, your intake submission, and delivery, and use them to respond to disputes.
5. Your responsibilities
Give accurate, complete information about your health, injuries, training history, and goals; answer screening questions truthfully and get physician clearance if advised; follow programs as written or tell us when you cannot; tell us immediately about new pain, injury, or a change in your health; and use our services only for yourself.
6. Intellectual property
The MB Move Better name and brand, assessment frameworks, programs, reports, videos, and training materials belong to MB Move Better LLC and are protected by U.S. copyright and trademark law. Deliverables are licensed for your personal, non-commercial use; do not copy, resell, share, or publish them without written permission. You keep ownership of your photos and information; you license them to us only to perform your service, and for marketing only if you sign the separate Marketing Content Release.
7. Medical disclaimer
Our services are fitness and educational services, not health care. Matthew Booska is not a licensed physician, physical therapist, chiropractor, registered dietitian, or mental-health provider, and nothing we provide is medical advice, diagnosis, or treatment. A photo-based posture review is not a medical examination and cannot detect or rule out injury or disease. Nutrition guidance is general guidance for healthy adults, not medical nutrition therapy. Consult a qualified provider before starting any program; stop and seek care if you have concerning symptoms. The full Medical Disclaimer is part of these Terms.
8. Assumption of risk
Exercise carries inherent risks, including soreness, strains, sprains, joint injury, and in rare cases serious injury. By using our services you knowingly and voluntarily accept those risks, including for exercise you perform unsupervised.
9. Confidentiality and your consents
What you share is used only to deliver and improve your service, as described in the Privacy Policy. Your photos and intake answers are collected under the Assessment-Use Consent on the intake form, which permits use only to perform your assessment. We never use your photos, results, name, or likeness in marketing unless you sign the separate, optional Marketing Content Release; declining it does not affect the service you bought. We may describe anonymized, non-identifying patterns in educational content.
10. Limitation of liability
To the fullest extent California law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages arising from the site or our services, and our total liability for any claim is limited to what you paid us in the twelve months before the claim arose. Nothing here limits liability that cannot be limited by law.
11. Governing law and disputes
These Terms are governed by California law. We will first try to resolve any dispute by good-faith discussion; if unresolved after 30 days, either of us may submit it to binding arbitration in El Dorado County, California, under American Arbitration Association rules, each party bearing its own costs. Either party may instead bring an individual claim in small-claims court.
12. Severability and entire agreement
If any part of these Terms is unenforceable, the rest remains in effect. These Terms, the Refund & Credit Policy, the Medical Disclaimer, the Privacy Policy, and any consent or program agreement you sign are the entire agreement between us.
13. Changes
We may update these Terms; the version and "Last updated" line will change, and active clients are emailed about material changes before they take effect. Continued use after a change means you accept it.
